Terms & conditions are the fine print we prefer to write in big letters. Read them at your leisure — if anything is unclear, ask and we'll explain.
01Parties & definitions
Atlanticasa BV, established at Boerenverdriet 20, 4613 AK Bergen op Zoom (the Netherlands), and its Portuguese office Atlanticasa Lda. (NIPC 516.483.291) in Lagoa, Algarve, hereafter jointly: "Atlanticasa", "we", "us".
"Client" means: the natural or legal person entering into an engagement agreement with us for guidance in the purchase, valuation, viewing or (re)financing of real estate in Portugal.
"Services" means: all activities we perform under the engagement — from orientation call to key handover.
02Applicability
These terms apply to all offers, engagements and agreements between Atlanticasa and the Client. Deviations only apply insofar as they have been agreed in writing.
The orientation call (30 minutes, free) is not an agreement and binds neither party.
03Our services
Atlanticasa typically provides the following services:
- Profile definition and regional advice (orientation)
- Pre-selection of properties based on wishes
- Viewing guidance on location
- Negotiation and offer guidance
- Coordination of legal due diligence (via selected Portuguese lawyers)
- Introductions to Portuguese banks for mortgage applications
- Guidance on NIF applications and notarial process
- Optional: arrival and settlement package
04Guidance fee
Our fee is a transparent percentage of the final purchase price, with a minimum amount. The percentage and minimum are recorded in writing in the engagement confirmation before signing.
Standard rate: 1.5% of the purchase price, with a minimum of € 15,000. This covers the entire process from orientation to key handover — there are no hidden intermediate charges.
The fee is invoiced on the day of escritura (notarial transfer). If the Client terminates the process after viewings but before escritura, the arrangements in article 08 apply.
05Viewings
Viewings are carried out exclusively by an Atlanticasa advisor or a local partner appointed by us.
In case of no-show without notice within 24 hours of the scheduled time, we reserve the right to charge travel and waiting hours at € 75 per hour, with a minimum of € 300.
For viewing trips longer than one day (multi-property visits with overnight stay), we make separate price arrangements in advance.
06Liability
Atlanticasa will use its best insight and ability to guide the Client to a successful purchase. This is a best-efforts obligation, not a result obligation.
Our liability is limited to the amount paid out under our professional liability insurance in the relevant case, plus the applicable deductible. If for any reason no payout takes place, our liability is limited to the fee actually paid.
We are not liable for: (a) inaccuracies in information provided by third parties (owners, brokers, legal advisors); (b) future market developments or value fluctuations; (c) decisions made independently by the Client after completion of our engagement.
07Confidentiality
All information exchanged under the engagement is confidential. We do not share client data or search preferences with third parties beyond what is necessary (lawyers, banks, owners — only with explicit consent).
Off-market properties are subject to strict confidentiality. The Client agrees not to share this information with third parties without our written consent.
08Termination
Both parties can terminate the engagement at any time in writing.
Upon termination by the Client after the viewing phase, before an offer is made, a reasonable compensation for hours spent applies at € 90/hour, with a maximum of € 2,500.
Upon termination by the Client after an offer that received verbal or written acceptance, the full guidance fee is due.
09Disputes & applicable law
All agreements with Atlanticasa are governed by Dutch law. Disputes are preferably resolved by mutual consultation or through mediation.
If this does not lead to a solution, the dispute is submitted to the competent court in Amsterdam, unless mandatory law designates another court.
For our services in Portugal (escritura, local legal coordination), additional provisions of Portuguese law may apply; in that case they prevail insofar as necessary.
10Changes
We reserve the right to change these terms. Changes are published here and, for material changes, also actively emailed to existing clients.
For ongoing engagements, the terms as they applied at the moment of engagement acceptance always continue to apply.
